Privacy Policy

The confidential treatment of your data is our highest priority. We want to provide you with the greatest possible protection of your privacy. We process your data provided by use of the "Mommymove" app and the website exclusively within the scope of consent that you have granted as well as legal data protection regulations. The processing conforms with this Privacy Policy.

The Privacy Policy shall be updated as necessary. We will inform you of the updated terms by display notification and then request you to accept the amended terms.

2. COLLECTED DATA

We collect personal data based on your consent, for performance of the Agreement and/or to satisfy a legal obligation.

2.1. Information submitted during registration

If you wish to use the app, you must register as a user. The following information is mandatory when you register:

First and last name
E-mail address
Password
IP address

2.2. Usage Data

We also collect the following data:

Device data
Firmware version
Version of the app
Usage data for the app (app settings, menus and settings clicked, functions used, including frequency, time and duration, error notification)

2.3 Information submitted when concluding a Subscription Agreement

We must collect the following data when you conclude a subscription agreement:

Date of birth
Date of delivery
Statement of a positive final examination
Results of beginner test
Workout results

In order for us to provide you with an optimal workout plan designed perfectly to meet your needs and to personalise your user profile, you have the option to provide additional information:

Number of births
Type of birth
Condition of pelvic floor
Condition of rectus diastasis
Symphysis symptoms
Breastfeeding situation
Prone position option
Location information
Profile picture

Some of the personal data collected contains sensitive personal information, as the data can be combined to draw conclusions concerning your health (health data).

Consent wording for data processing in respect of Subscription Agreement:

"By selecting "I agree", you confirm that you have carefully read and understood the Privacy Policy and consent to the processing of your personal data including your health data (sensitive personal data) in accordance with the provisions of this Privacy Policy. You may revoke this consent at any time."

3. THE PURPOSE OF USING YOUR DATA

We process the personal data that you provide on our app or website in order to pro-vide those Mommymove app services or functions that you request. The obligatory in-formation for concluding the subscription agreement serves to verify that you are us-ing the app in accordance with our GTC and Terms of Use. Mommymove's services cannot be used without the obligatory information.

Based on the additional voluntary information, Mommymove uses complex algorithms to generate workout plans individually tailored to you.

4. DATA TRANSMISSION

Personal data is only transmitted to third parties or contract data processing suppliers where necessary for these purposes. Data is only transmitted to third countries if this is expressly noted in this Privacy Policy.

We take appropriate measures to ensure that third parties comply with an adequate level of protection for personal data.

5. ERASURE OF DATA

Stored personal data shall be erased if you revoke your consent to store your data, if your information is no longer required to achieve the purpose pursued by storing your data or if the storage of your data is or becomes inadmissible for other legal reasons. However, you can no longer use these services if your data is erased or blocked.

The data stored on your device will be erased as soon as you delete the Mommymove app.

Your voluntary data stored on our server will be erased if you request that we do so. You can make this request simply by notifying us at support@mommymove.com. In this case, only the obligatory information will remain on the server. You can only erase this information if you delete your entire account.

6. PROCESSING PERSONAL DATA FOR ADVERTISING PURPOSES

We are happy to inform you about topics concerning your personal Mommymove Workout as well as our services in our newsletter if you have granted us consent to do so or provided that this complies with legal regulations.

By registering (double opt-in process) for the newsletter, you agree to receive the newsletter. The data collected will only be used to send the newsletter. Our newsletter is sent via MailJet, 37 Bis Rue du Sentier 75002 Paris, France.

You may revoke your consent to receive the newsletter and the collection and storage of data associated therewith at any time. You can revoke your consent using a link in the newsletters or by informal note to Mateo Health GmbH, Steinerner Weg 10, 97276 Margetshöchheim or by e-mail to privacy@mommymove.com.

Declaration of consent in respect of the Newsletter:

"I agree that Mateo Health GmbH processes my personal data to keep me regularly informed by e-mail with news about my workout, offers from Mateo Health GmbH and topics on exercise, nutrition and being a mother. My personal data will be processed in accordance with the provisions in the Privacy Policy. I may re-voke my consent to Mateo Health GmbH at any time."

7. COOKIES AND TRACKING ON THE WEBSITE

We use temporary session cookies and permanent cookies. Cookies are text files that are stored on your device that enable analysis of the use of the app. We use cookies and other data collection tools to capture data that helps us to personalise the Mommymove website.

We use the following tools for this purpose:

7.1 Google Analytics

We use Google Analytics on our website, a web analysis service of Google Inc. (here-inafter "Google"). Google Analytics enables an analysis of the user's utilisation of the website. Examples of data collected include information about the operating system, the screen, your IP address, access to website views, date and time that you visited our website. As a rule, the information generated about your use of the website will be transmitted to a Google server in the United States and stored there. We have activated IP anonymisation. Therefore, Google will shorten your IP address within Member States of the European Union or in other States party to the Agreement on the European Economic Area prior to transmission. Only in exceptional cases will the full IP address be transmitted to a Google server in the United States and shortened there. Google will use this information on behalf of the website operator in order to analyse your usage of the website, to compile reports concerning the activities within the app and to provide additional services associated with the use of the website for the pro-vider of the app. The IP address transmitted within the scope of Google Analytics will not be merged with other Google data.

You may prevent the collection of the data pertaining to your use of the website (incl. Your IP address) for Google as well as Google's processing of this data by deactivating Google Analytics in your browser.

Please note that Google Analytics was configured on the website to ensure the anonymised collection of IP addresses (what is referred to as IP masking).

7.2. Google AdSense

We use Google AdSense on our website, a service for displaying advertisements. Google AdSense also uses what are referred to as web beacons (invisible graphics). Web beacons can be used to analyse information such as visitor traffic.

Information generated by cookies and web beacons concerning use of the website (including your IP address) and delivery of advertising formats will be transmitted to a Google server in the United States and stored there. Google may share this information with Google contract partners. However, Google will not combine your IP address with other data that you store.

7.3. Facebook Custom Audiences

We use Custom Audiences on our website, a service of Facebook. In principle, a non-reversible and non-personal checksum ("hash value") will be generated from your usage data which may be transmitted to Facebook for analytical and marketing purposes.

7.4. Optimizely

We use Optimizely on our website, a service of Optimizely, Inc., (hereinafter "Optimizely"). Optimizely uses cookies. The information generated by these cookies concerning your use of this website will generally be transmitted to an Optimizely server in the United States and stored there. However, if IP anonymisation is activated on this website, Optimizely will shorten your IP address within the Member States of the Euro-pean Union or in other States party to the Agreement on the European Economic Area prior to transmission. Only in exceptional cases will the full IP address be transmitted to an Optimizely server in the United States and shortened there. Optimizely will use this information on behalf of the operator of this website to analyse your usage of the website and to compile reports concerning website activities. 8. TRACKING IN THE APP

We use the following tools to analyse the app:

8.1 Xtremepush

We use Xtremepush, a service of Xtremepush Ltd., First Floor, 83-87 Ranelagh, Dublin 6, Ireland, to analyse app usage. For its analysis, Xtremepush uses IP and Mac ad-dresses which are, however, exclusively used on an anonymised basis. It is not possible to make inferences to natural people by doing so. The information collected from this process are used exclusively to analyse the function and use of the app by creating anonymised evaluations and graphics of the number of visits, number of pages accessed per user, etc. The analyses are used exclusively for the purposes of internal market research and for the optimisation and needs-based design of the app.

You may object to Xtremepush tracking by selecting "privacy" from the menu and de-activating the use of Xtremepush there.

9. ACCESS AUTHORISATIONS

For optimal use of the services, Mommymove needs authorisation to access various functions and information on your mobile device. We request access authorisation from you prior to your first use.

You can revoke these access authorisations at any time. However, revoking these access authorisations could result in a limitation of the range of functions.

Mommymove requests the following access authorisations:

Camera, to be able to take a picture for your profile
Photo library, to be able to select a picture for your profile
Location for statistical analyses and to send push messages
Permission to send push messages in order to be able to send push messag-es to the user
Mobile data, in order to load mobile content from the web
Biometric security features to protect the app from unauthorised access at customer request

10. DATA SECURITY

We will protect your personal data from risks associated with data processing, particularly unauthorised access, use or disclosure. We maintain relevant technical and organisational measures for this purpose. Your personal data is always transmitted in encrypted form (SSL).

11. YOUR RIGHTS

11.1 Right of Revocation

You have the right to revoke at any time the consent that you have given to process your personal data with effect for the future.

Revocation does not affect the lawfulness of the processing based on your consent which has occurred up until revocation.

11.2. Right to information

You have the right to demand information concerning your stored personal data free of charge. At your request, this information can also be provided electronically.

11.3 Rectification and Erasure of, and Restriction of the processing of, Data

You have the right to demand the rectification and the erasure of, or the restriction of the processing of, your personal data. However, if your data is erased or blocked, you can no longer use the relevant services.

Your right to erasure can be precluded by statutory retention obligations.

11.4 Data Export

You have the right to have us provide you with or transmit to other controllers in ma-chine-readable form data that we process using automated processes or which you have consented to being used.

11.5 Enforcement of Rights
